Free Corey Delaney!

Well, not really, but I hope the charges possibly laid against him are substantive ones and not just related to being an idiot. (It’s difficult to tell whether he has in fact been charged and if so, with what offence or offences as Victorian law prevents the names of the “two teenagers” being released, though his arrest was apparently not subject to any reporting restrictions).

There are actually some serious issues here.

First, while I’m all for individual responsibility, I don’t see why the Victorian Police have a right to bill anyone for doing their job and still less to charge one individual for property damage he can’t solely have been responsible for. By all means proceed against individuals against whom concrete facts can be alleged, but some sort of exemplary punishment seems ludicrously contrary to any notions of due process, and for that matter, the presumption of innocence. David Hicks was someone a lot of people might have thought reasonably to have been acting foolishly, and though the scope of the miscarriage of justice in the Hicks case far exceeded in seriousness what’s going on here, as far as I’m aware, there are idiots who are 66 as well as 16, and lacking judgement or being a dropkick is not a crime in and of itself.

Secondly, it’s not all the fault of the intertubes. I remember parties getting out of control when I was a teenager in the 80s, and uninvited yobs turning up, and kids doing dumb things like smashing garden gnomes and urinating on cars. No doubt it’s very unpleasant for all concerned, and shouldn’t be condoned, but surprise, surprise, stuff happened before text messages and Myspace existed.

Thirdly, the coverage of all this by the media is beyond belief. There’s a complete timeline up to midday today in Crikey, for those who want to review it. Particularly if there are laws preventing publicity for underage offenders, it seems to me that news organisations had no duty to assist Corey Delaney in making a fool of himself, and given his age, a positive duty to refrain from doing so.

Corey’s irresponsibility is mirrored by that of the media and the absurd nanny-statist Laura Norder-ism that state governments are so prone to.

    That’s on the web too, but it’s impossible to know who’s been charged with that. Given that the assumption will no doubt be made that it was Corey Delaney, this seems all the more reason why the media should never have allowed him his fifteen minutes of fame, and the simultaneous lynching.

    Jump on a minor story and go feral on it – a pack mentality forms and each media outlet just keeps reporting on it. Chasing a immature 16yo around with camera’s and interviews – what sought of ethical standards do the media have – none apparently.

    The media pack going feral seems to be a common occurence – last week it was the cricket controversy – nonstop leading story for a week!

    Yep, there are laws in Victoria – the Children, Youth & Families Act of 2005 prevents under-agers involved with the law from being identified by media outlets.
    This law was enforced (in 2005 or 2006, if memory serves), and several media outlets were fined tens of thousands of dollars for ignoring the requests of the Melbourne Children’s Court to refrain from publishing on a legal matter.

    Fantastic. So now we know why. I wouldnt quesiton any further and leave it at that.

    But, if I had to consider it further I would say, Mark you are right, the media is quite to blame. Corey shows all the beautifully clueless amorality of a kid who is thrust into the limelight and is encouraged and rewarded, yes rewarded for his amorality. (He has been offered all sorts of jobs, flights you name it) His performances fit directly into the teenage stereotype of the spoilt aimless youth with a lack of conscience. We love those stories. Without this unabashed refusal to be ashamed, there would be absolutely no story. Its feeding our well worn tropes of deviant youth. God we’re boring.

When I was an immature 17/18 year old in Sydney I went to quite a few parties in inner Sydney that got way out of control and most of the people who went to them were way older than me. You disn’t need text messages or Myspace. You just went5 down to the Royal George or the United States or the Criterioon and told people there was a party on.

    Well actually it was the ‘blame John Howard bit’ I found a bit funny….but Im sure you mean that Corey is following the plan, cause Casey sure as hell is beyond it, sigh. What would it be like to be Corey? all young and pain in the arse cool, all dressed up in crappy sunnies and fur trimmed snow jacket in the height of summer with no where to go verve, all 15 minutes of trash tv fame and noteriety….God I feel sorry for Corey.     While I also question the newsworthiness of this topic, I think it’s important to note that early news reports that identified the teenager would have been published before allegations of criminal behavior were made. It’s possible the media began to cut out his name as they became away of the fact (The Age article mentions they can’t identify him). Although I think the cat was more than halfway out of the bag on this one.

    $20k and child porn charges appear to be a case of the police inappropriately reacting the widespread coverage. He’s a kid that needs a to be given a bit of a whack with the clue stick, not be screwed over for life.

    Possibly the arrest was a bit of a stunt. Given the time delay between the party and the arrest, there doesn’t seem to have been much immediacy to it.

    Sure I got into trouble with the cops but I fought or talked my own way out (or in) to it.

    There have been persistent problems with the police in Vic for many years, and inquiries and Ombudsman’s investigations don’t seem to have stamped them out. You could run a whole other thread on the multitude of shameful stories out there that relate to Vic police.

    Not to mention the Four Corners show on that Mullett character and the police union. Isn’t he charged with something now?

    It’s all very reminiscent of Joh era Qld – coppers busting kids on rubbish charges, going nuts with excessive force, acting like they own the show, a police union which wants to be a political player, rumours and whiffs of corruption only occasionally surfacing and all sorts of deliberately ineffectual “complaints commissions” and so on.

    The only difference appears to be that under Joh, the government loved all this and was in it up to its armpits, whereas in Vic what I assume we have is a cowed and pliant Labor administration going down the low road of “getting tough” by agreeing to and defending every police request or behaviour with no discrimination whatever.

    There really is lots of value – for good honest coppers too – in an inquiry which doesn’t just clean out the rot but also has the demonstration effect of reminding the force that they’re there to serve civil society and are not above the law.

    The Labor Govt is probably more sophisticated that Joh when it somes to PR and spin. They’ve avoided a lot of the ’scandal’ faced by QLD and NSW Govts, and they haven’t necessarily been that much better.

    Any inquiry into Vic police would need to be a Royal Commission.

    Falconer din’t come on board until 2004, 2 years into the Royal Commission.

    To be perfectly honest, Corey is a downright spoilt little brat.

    I’m an 18 year old who loves a night on the town. But I have an incredible level of respect for my parents. I appreciate & understand how hard they’ve worked to give me the house & education I have today.

    Corey is lapping up the attention, and he’s too cowardly to go home & face the real music. But yelling at this kid will be like water off a ducks back – pointless. By offering him gigs & money to be interviewed, that’s not discipling him, it’s giving him his 15 minutes of fame. But eventually he will have to go home & confront his parents. At the VERY least, they deserve an apology & an explanation.

    Corey’s 16 years old now. He’s allowed to leave school. He’s allowed to move out. He’s at the age to face responsibility for his actions. He knew perfectly well what situation he was putting himself, and his home in, on Saturday night by posting that MySpace Bulletin.     Without knowing the particular circumstances of the Bondi case, if I was a cop standing in front of a knife wielding person, schizo or otherwise, and that person made a play towards me, I would not be aiming for his leg, I’ll give you the tip. To train cops to shoot in the leg to immobilise would open up a whole new can of worms, wouldn’t it? Imagine a cop shooting a villain in the leg to immobilise but accidentally hitting a major artery causing fatal wounds. It may have been a case which the cop wouldn’t otherwise have shot but now he is going to find himself in ten types of legal hurt. But surely, a dose of a Taser would be a win-win in many of these cases? (Obviously weren’t available in the Bondi case)

    Actually, Steve, I used to manage a mental health deinstitutionalisation program and have in fact been confronted with a floridly delusional schizophrenic client wielding a knife.

    On my own. For half an hour.

    I talked him down, got the Sam.T. Hell out, and liaised with Community Mental Health and the cops to ensure he wasn’t harmed.

    He was fine the next day after a shot of Clozapine. He lives a fruitful life in the community with weekly visits from Community Mental Health to make sure he’s med-compliant.

    So, yes, I guess Ive walked the walk, thanks. My view remains unchanged.

    An its not just an anecdote – its also accepted practice for interventions in some states. Our service used to train in police education and liaison. Not something that happens in all states – but should. Fact is, most cops dont understand the episodic nature of mental illness at all. This is the part of the problem. Maybe yours too.

    Basically, I dont accept that unwell people, outnumbered, with a less threatening weapon than a gun, need to be killed to be overpowered.

    And how “often” you confront the situation is wholly irrelevant to that basic principle.

    Here’s one for you: can you tell us where the cutoff is for lethal force being applied by trained law enforcers?     The cutoff point for lethal force is simple, when an offender is not offering lethal force, and is not likely to. Don’t want to be sorted out by cops with superior weapons? Then don’t wave a knife at them. Myself, I have always wondered why with that many cops they didn’t draw batons & belt him one. This may have resulted in the offender having a broken arm. Shooting him seems rather extreme.

    You don’t read much of what I post FDB, or you would know that I am a very outspoken opponent of police using lethal force. Try a bit more reading, and a bit less of assumptions and throwing cavalier “apparently…” into your postings.

    Obviously, police should always shoot to kill, provided they warn their targets with some kind of pre-action-reel catchphrase, and provided the target has also been given time to utter some kind of identifying catchphrase or epithet against the firing police officer before they’re killed. In the case of crowds of criminals, this might be waived, depending on the size and nature of the gang, and whether they’re armed also with firearms, or simply with knives, swords, cleavers, etc. In the case of vehicle-to-vehicle firefights, police may only fire one-handed. Ninjas, of course, should only be defeated in single combat, if at all.
    Police also should be trained to be especially careful of plot-centred villains, who often recover from mortal woulds in order to fire last shots during dialogue.

    I am actually on the web looking for a lativan husband so I really don’t know why I am here but I thought I would give you my five cents worth. Last year I decided to buy a new house. In the search for a property in a particularly nice suburb I found the house of my dreams, a little expensive prehaps but with all the requirements I desired.

    It was also next to the rented premises of a policeman, who was of lativan descent and as a result dropped dead georgous. (tall, blond, blue eyed so stylish we all thought he was gay).

    Friends of mine, who lived in the suburb said to me ”watch the area its a bit rough and ready” so I went and spent a couple of hours in the car to see what the area was like, and low and behold we got a party not disemilar in appearence to the party DC orgainised. (being me I gate crashed and had a great time,nothing like the chat up lines from dum teenages desperate to lose their virginity.I’m thirty eight, the max age was eighteen)

    I gave the area the benifit of the doubt and went back a couple of more times at odd hours. every thing seemed ok apart from the domestic up the street. So I thought prehaps I would approch forementioned hot lativan policeman and ask his opinion?

    If you value your life and freedom do not under any circumstances ask victoria police for anything.

    As a result I now have a intervention order and a possible case for stalking. ten cops came and searched my house going though my patchwork, knitting, cross stich patterns, one of my computers was seized (Remember I want to buy a house). The house has been pulled from the market by the owners who were unable to sell the property as every prospective buyer ended up with an intervention order.

    one of my teenage sons now live in a two car garage, as its the only way I can stop the fighting between the three of them.

    roll on royal commission I am ashamed to admit I am from victoria, the worst however is I still think this bloke is hot.

    In the last few years I have had;

    - human arm found on railway line; when I rang the cop shop bloke on phone recited to me ‘don’t worry lady, person it belong too is pretty ‘ármless now’ (such compassion, how will victoria cope with such dedication?)

    - mentally unstable man break into the house at 6am in the morning. After helping him to the front door, eldest son rang triple 0 for assistance

    police arrive at 1.30 pm in the afternoon six hours after incident why would you bother ?

    - arrived home to find all windows broken by what appeared to be slug gun. walked broken window around to neighbour hood watch coordinator who rang the police on my behalf. still waiting for attendance, that was october 2005.

    - had mum’s cat eaten by a staffy dog, when I attempted to adjust the attitude of the owner coped a punch in the nose. Police attended on the request of neighbour. Nothing can be done about the owner of the dog because he is a druggie.

    - house fire had to rescue elderly neighbour from burning house. suprisely police actually attended after I had completed rescue, which is lucky for me because I propably would have been trapped by them inside the burning house, windows broken in fire arm incident have now been fixed. couldn’t get hose over to the fence to squirt cop i can’t stand, which was the biggest disappointment of the night.

    brohers house broken into all his cash cloths and food pinched. found offender and got his stuff back after a ‘discussion’ with the female druggie who did the pinching. he is charged with assualt she walks scot free.

    - my intervention order. beautiful house, five bedrooms premier schools, hot lativan neighbour, could almost pay cash. What am I going to do to the hot neighbour, give him a few cupcakes? offer him a sausage in bread when we have a bbq? Beef goulash mash potaoes lativan sourkraut on a cold winter’s night ?

    maybe he had concerns about my plans for the pool?

    need help? been raped? victim of domestic violence? copped a flogging in the main street – do not ask for help because you will not get any, particularly if your of aboriginal desecent and come from Moe.

    After reading through this lengthy thread, I realized that I couldn’t go without commenting.
    I’m 48 yrs old, and between my wife and I (re-married) have 5 kids and one grandchild.
    Haveing gone through the teenage years of all our kids, I’ve seen a LOT! Our youngest, now 21, has a lot of friends so like Corey it is amazing, any one of which he could have been modeled on. I wouldn’t waste a vegemite sandwich on some of them to be honest. But over the years I’ve seen more of them mature into reasonable human beings.

    But as has been mentioned, stupidity is not in itself a crime. maybe disrespect perhaps should be though.

    Over the years, each of our kids have had parties that got a little out of hand, and a lot of the ‘peers’ treated it like it was their right as a guest in our home to wreak havoc, where and when they saw fit. Result…..ejected or in a couple of cases, police were called.
    In every case, our kids had the respect, not to mention guts to aplologize for their actions in allowing things to go awry, and usually managed to get the offenders to apologize to us. End of problem.

    In Corey’s case, the problem lies in a few areas.

    1. Not enough guts to approach his parents to apologize or even talk about it.
    2. He actually thinks himself a hero for his part in this whole thing.
    3. The only reason he is being offered anything at all is because of the sensationalism the media so fondly crave, but that is their job I suppose.

    His use of an internet site, and the resultant furore, would probably have resulted in 50000 idiots attending if it had been held in the US, rather than in a back suburb of Melbourne. Nothing new here other than the huge increase in accessibility to the masses.

    I realize that most kids can access booze too easily, and we’ve got a long way to go before we get that issue under control, but that’s at the heart of things.

    At the end of the day, the losers here will be the parents of kids who are even marginally as idiotic as Corey, their job just got a lot harder. I hope my granddaughter learns that having fun shouldn’t come at others expense.

    Is it really fair that this kid is held directly responsible for the actions of other assholes who showed up at his house? In this outrageously bureaucratic world, we assume it would be so. Any person is free to host people on his private property, and property damage committed by others once they have left his private party is clearly not his responsibility. To say so would be like holding the owner of a bar responsible when a patron leaves drunk and mows somebody down in his car. Unless he’s being sued by parents for providing their children with alcohol (which is fairly ridiculous considering the ease with which minors get alcohol and the degree to which minors are actually drinking [in most cases more responsibly than those who are of age {from personal experience}]), then there is really no cause to criticise this kid for anything, period.
    Unless of course you hate having a good time.

    Personally, I think it’s awesome when a 16 year old kid has guts enough to give the proverbial finger to the media monkeys. Really inspiring.

    Er… D.B.B. Bar owners ARE held responsible if a patron leaves drunk & mows down somebody in their car. EVERY incident, on or off the premises,no matter how minor, involving alcohol, has a liquor report made naming the premises which supplied the liquor.

    This report is not necessarily accurate, however the incident goes on the “sheet” for that premises. If it is a serious incident, there is a very unhappy investigation conducted of the premises’ (& staff’s) possible culpability regards irresponsible/illegal provision of alcohol.

    That said, it seems a bit of a stretch to blame him for the actions of gatecrashers. However if they were invited guests (myspace:”Everybody who reads this come to my place for a party”) then he IS likely to be held responsible for their actions.

    There’s a related story which suggests the trouble started after two other teen parties in the area were closed down by the cops around 11pm, leading all the partygoers to go to Corey’s party.
