Today brings another of those MSM v bloggers moments. Itâs bloody irritating to find myself obliged to tug the forelock to Mr Big-Shot Age Legal Affairs Reporter, Kenneth Nguyen, for this report on page four of the Saturday Age:
Attorney-General Philip Ruddock has denied a report in The Age that said the Federal Government planned to stop recognition of adoptions of foreign children by same-sex couplesâ¦
According to Ruddockâs letter to The Age:
It is wrong to say that adoptions of foreign children by same-sex couples will not be recognised in Australia (The Age, 2/2). In fact, The Age was advised before publication that âif same-sex couples wanted to go overseas and adopt in compliance with the laws of that country, we would not stop them from doing that. However they are not allowed to use the Governmentâs inter country adoption program. None of the countries with which we have an agreement permits same-sex couples to adopt.â?
If none of the countries with which Australia has agreements for inter-country adoption permits adoption by same-sex couples, then this piece of proposed legislation is unnecessary:
Family Law (Same Sex Adoption) Bill
– amend the Family Law Act 1975 to indicate that adoptions by same sex couples of children from overseas under either bilateral or multilateral arrangements will not be recognised in Australia
I think Iâll have to take a look at the draft bill as soon as itâs available. Thereâs a hint of something a bit too clean-shaven in the Attorney-Generalâs letter.



There is a sleight of hand in that.
Not recognising someone as an adoptive parent is different from stopping them from going overseas to adopt. Of course the government can’t stop anyone from going overseas to adopt (or do anything else, like get married.) But they can pass a law which would refuse to recognise such an adoption in Australia, just like they currently refuse to recognise the gay marriages performed in countries like Canada.
It’s true too that many of the countries which are sources of adoption eg China, don’t allow same-sex adoption. Some countries and even some US states eg Texas, do. Some Australian states allow a same-sex partner to adopt the child of their partner. Presumably, some couples (we’re probably talking about six people here, not worth the lawyers’ fees to draft these bills, but worth gold to a government which likes to manipulate prejudice) try to play all these systems so that both partners end up as adoptive parents. My bet is that it’s this which the government will try to close loopholes on.
Ok, so if the federal law is passed, could that be used to mount an inconsistency challenge against any ACT/NT laws that allow a same-sex partner to adopt the child of their partner…?
Probably not, as there is specific reference to adoptions from overseas.

I was just thinking this morning that Kenneth Nguyen is the best thing The Age has had for, well, ages.
I’m still trying to grasp the distinction between not recognising overseas adoptions, and preventing access to “the Government’s inter country adoption program.”
Is this about not recognising the adoptive parents as parents for the purpose of immigration? In this instance, the infant would be independently trying to get an Australian residence visa, for which it is not legally able to apply.
Yet another catch-22.
In the absence of any close relative wanting to adopt, only vetted, married heterosexual couples should be able to adopt here or overseas. Otherwise you could have all sorts of ridiculous and dangerous scenarios. As for poofters adopting from third world countries, spare us the usual drivel.

Actually, what I think Obs is saying is that he enjoys thinking about those things that fill him with horror. He’s a weird dude after all.
Scratch a left liberal gaia and you’ll eventually come up with their true unnatural self. Having kids naturally takes a mum and a dad, but hey some pairs can’t have em so that’s not fair the gummint orta do sumpink about it and so sponsored IVF. Hey and some don’t want em so the gummint orta sponsor that too and hells bells what if they’re not a boy and a girl, that’s not fair and so what about IVF for the sads who can’t be and so why can’t a bloke marry 3 sheilas or football teams get married or Hindus marry cobras or trees or whatever… Ditto with adoption. My 19yr old daughter has to have a police clearance to coach a Primary School netball team with parents present Mark, so I’m understandably a little skeptical of free for all adoptions by unnatural parenting combos. That’s where community standards are at today in case you’re not up to pace.
