There was some interesting discussion here at LP recently on this thread about the right to free speech, which I think took far too narrowly American and thus falsely universal a view. In the common law tradition of Britain and Australia and comparable countries, there hasn’t historically been a legal right to free speech (except in Parliament!). Though that’s changed to some degree here, and in Britain because of the importation of civil law jurisprudence via the European Union, it has always been the case that protection from intrusion and protection of reputation have been significant barriers to press “freedom”. Defamation law, however, is a blunt instrument when it comes to protecting privacy, and the Australian Law Reform Commission has released a report suggesting higher barriers for media intrusion into people’s private lives. The Right to Know Coalition - an organisation of Australian media companies - vigorously opposes any new legal protections for privacy.
In an op/ed pushing this barrow in The Australian, UQ’s Garrick Professor of Law James Allan makes the case against, predictably roping in the general conservative suspicion of any measure that might resemble a bill of rights. He concentrates on a recent UK case which turned on a right to privacy, brought by motor racing boss Max Mosley. Mosley’s adventures with sex workers and domination scenarios in a basement were reported by a British tabloid, and the story had all sorts of salacious elements - including the fact that Mosley’s famous father Sir Oswald was a home-grown British Fascist. But the court found that there was no public interest in revealing all this, and indeed it’s hard really to see what that public interest might be. The suggestion from the media crew is that “ordinary people” don’t have to worry about such intrusions into their private lives. But is that so?
In the spheres and circles in which Planet Janet moves, it’s “defend the Enlightenment” week. At first, I thought this was just the latest volley in the denialist wars, but now that we know that Ayaan Hirsi Ali is in town, and her usual fanbois are overcome with their customary posture of uncritical worship, I suppose that explains part of it, even if “We are at war with terrorism!” no longer packs so much political punch as a slogan. Indeed, there might be a bit of an exercise in parsing exactly why - in “an enlightened spirit of inquiry” - Planet’s proclamation that -
There is no doubt the West is suffering from a dangerous moral disorientation. It is not clear that we value the very idea of the West any more.
- is such an incoherent notion. In part that would be because the bricks she’s used to construct her discourse (her word, not mine) now no longer fit together anywhere so neatly as they once did, because the mortar of her political obsessions has grown old and cracked. But I’m not particularly interested in doing that, so I’ll use her as a segue to a consideration of the latest shot in the “higher education wars” - an article today by Gavin Kitching entitled “Paralysed by Postmodernism”. UPDATE: It has been pointed out in comments that LP has not discussed the Rudd government’s continued determination to introduce ISP-level internet filtering this week. To redress that lack I’ll quote a post I made at Hoyden About Town a couple of days ago in its entirety below:
No surprises: internet filtering test results show products block legitimate content
We said it would. Despite a cheery press release from Communications Minister Stephen Conroy that all is going well, an analysis of the actual test results shows that the tested filters slow connection speeds significantly (which means ISPs would have to increase capacity, the costs of which would be passed on to consumers) and have a false positives rate that would block at least 10,000 legitimate sites (and that’s for the best product result - most would block more). It gets worse:
None of the products could effectively filter instant messaging, streaming video, peer-to-peer file sharing like BitTorrent, newsgroups or newly-invented Internet protocols except by blocking them entirely. Let’s count them again. None.
How long will the Rudd government continue to pretend that having this cumbersome, costly and ineffective product shoved at us under an opt-out scheme is in any way a good idea?
The Orwell Prize will mark the 70th anniversary of the Orwell Diaries by serializing them, one day at a time, on a blog — reminiscent of the way that Phil Gyford syndicated Pepys’s Diary.
The whole revival of Orwell thing is weird and so overdetermined. On one hand, there’s the Orwell as anti-po/mo theme. On the other, there’s Orwell as the “hero” of the “Decent Left” theme (cf. you know, everything Christopher Hitchens has recently written). What’s ignored and effaced totally is Orwell the polemicist in favour of imagining a postwar social democracy. If you read what he was saying in the 1930s, what he was wishing for - as a “realistic utopia” - was something very like what was envisaged in the whole Beveridge/Keynes libertarian social democracy vision. 1984 was also really meant to be more about the distortion of this “new Jerusalem” by the statist Labour Party than “Stalin”. But anyways… Orwell as a writer - and here I’d gesture to the almost forgotten Burmese Days - is also much neglected. Perhaps his diaries will stimulate a respectful consideration of him in regard to his own concerns not some dumbarsed political point scoring about teh war on terror or whatevs.
I haven’t seen any discussion in the blogosphere about the stories in the papers of the report of a major research project on Work, Life and Workplace Culture co-authored by Barbara Pocock and Natalie Skinner. Maybe we’re all too busy juggling work, blogging and life. But it’s a pity.
Since we do a fair bit of dissing the mainstream media round here, I wanted to observe that the story in the Sydney Morning Herald is an exemplary piece of reporting academic research into social issues - summarising the nuts and bolts of the findings and contextualising it with the every day lived experience of citizens.
We’ve featured a couple of posts here about the upheavals in the Anglican Church over conservative bishops’ hatred of teh gay, and the farce that is the Lambeth Conference, where openly gay American Episcopal Bishop Gene Robinson has been prohibited from attending - alone of all the 800 something bishops worldwide. At the earlier conservative meeting in Jerusalem, GAFCON, where Sydney’s own Archbishop Jensen was among the movers and shakers, the pr line was that the conservative African bishops were only concerned with the purity of the biblical faith, standing against all the terrible first world postmodern relativism.
In fact, the story of Nigerian Christian gay rights activist Davis Mac-Iyalla, who has just been granted asylum by the British government, goes a long way towards demonstrating what is actually at stake in the alleged Christianity of the Nigerian church’s hierarchy. As does their attitude towards legislation proposed in Nigeria last year. All this is very far from some genteel doctrinal dispute, or a culture war only violent in its rhetoric.
While it’s reasonable to ask, as Lyn at Public Opinion does, whether tracing every twist and turn of the opposition’s twisted trajectory towards some sort of agreed position on an emissions trading scheme, is to pay too much attention to a “policy cycle of sometimes less than 24 hours [which stretches] the notion of novelty a little far.” However, it could also be suggested that the interest lies in watching the moment that a “media narrative” switches, and as with the Costello crud, observing the process of constructing one, as a few bits and pieces of disconnected nonsense get tied together by assorted columnists and reporters and woven into a new thread that will then become - hey presto! - conventional wisdom, dignified as such on Sundays by the usual Insider suspects. You can shine a light on the way the press gallery mob do “the wisdom of crowds each other” by building a story arc, which then shapes the way the story is moved on.
Just a quick post to update some of the stories we’ve been following around the ecclesiastical traps - Irfan Yusuf, writing in New Matilda, contrasts the treatment doled out to Sheikh Al-Hilaly with the response (or lack thereof) from media and political figures to Bishop Anthony Fisher’s comments about survivors of sexual abuse. In an article on the same theme in Crikey, Yusuf links to a rather damning take at Media Watch on the News Limited coverage and commentary of accusations of church indifference to the victims of sexual abuse day raised during the World Youth Day event they were paid sponsors of.
Meanwhile, at the Lambeth Conference, conservative Anglican bishops are taking every opportunity to interrogate their fellow prelates about their ideological soundness on the loud condemnation of teh gay. Probably heretically, the Archbishop of York has suggested that there might just be more important issues for Christians than the ordination of gay bishops.
As a bit of a segue from my link to Eye on Big Brother’s last post, I was thinking a bit about Bianca and her body image issues, something I’ve discussed before. At one stage during Big Brother 2008, the narrative centred on Bianca’s breasts - her worries about her own body shape, her ambivalence about breast reduction surgery, and her displacement of her own troubled embodiment into criticism of Brigette and Rebecca and the other surgically enhanced FHM wannabes the show loved to cast over the last few years. She also had a bit of an awareness of how the womens’ bodies on the show functioned as signifiers of potential celebrity, and as objects to be scrutinised and traded among the men on the show - and implicitly the male viewers, though she didn’t really thematise this as such. Partly what was going on here was her own self-image and character work as “the smart chick”, but it’s also, when you reflect on it, I think, a classic example of how “society” is conceived in popular culture. I mentioned Rebecca Wilson’s comments on all the boob talk:
I think it was on the very first Big Brother Big Mouth this year that Rebecca Wilson asked whether it was normal for teenage and twenty-something women to talk so much about their breasts. She said that she couldn’t recall such discussions occurring when she was in her twenties.
It was a very easy contrast to make for the media - while World Youth Day 2008 has been acclaimed as a success by the Catholic Church in Australia, Anglicans were tearing themselves to pieces, with the decennial Lambeth Conference reduced to a farce. A large number of quasi-schismatic conservative bishops boycotted, having earlier set up a quasi-church outside the Anglican Communion’s traditional structures at GAFCON in Jerusalem.
So some politicians have finally noticed that when one group of people define torture so that it includes waterboarding and another group defines torture so that it excludes waterboarding, then the word torture itself becomes stripped of substance in terms of the debate over the ethical and humane treatment of prisoners (let alone which techniques are actually effective at intelligence-gathering).

The symbolism of the setting for the apology - a mass for seminarians and members of religious orders and the consecration of a new altar for the Cathedral - was no doubt intended by the Vatican to signal that the Pope was speaking sternly to those at the centre of the institution. But it’s also deeply problematic - as it suggests that the problem is only one for the church, excluding the victims who were left outside while the pomp and panoply of the liturgy took place for the exclusive benefit of the hierarchy.
In contrast to the media coverage earlier in the year when the People’s Republic of China suffered such an overwhelming public relations disaster in the context of protests from human rights and Tibetan activists against the Olympic torch, very little has been heard of Tibet in the mainstream media of late. All that we’ve seen lately in the Australian press is the solemn warnings from the Australian Olympics Committee that any athletes wearing an innocuous t-shirt with a generic human rights message offered to those interested by the Australia Tibet Council would be immediately sent home. Lest they annoy the Chinese government, and violate the “spirit of the Olympics” presumably. The corporate sponsored Olympiad brooks no petty “mixing” of politics and sport, of course.
